Overtime Pay Calculations:
Regular Pay: Hours × Hourly Rate
Overtime Pay: Overtime Hours × (Hourly Rate × Multiplier)
Total Pay: Regular Pay + Overtime Pay + Double-Time Pay
Effective Rate: Total Pay ÷ Total Hours
Federal Overtime Laws (FLSA):
- 40-Hour Rule: Overtime pay required for hours over 40 in a workweek
- Time-and-a-Half: Minimum 1.5x regular rate for overtime hours
- Workweek Definition: 7 consecutive 24-hour periods (168 hours)
- Covered Employees: Non-exempt employees under FLSA
State Overtime Variations:
- California: Daily overtime (8+ hours/day), double-time (12+ hours/day)
- Alaska: Daily overtime after 8 hours
- Nevada: Daily overtime after 8 hours (if agreed rate less than 1.5x minimum wage)
- Colorado: Daily overtime after 12 hours, weekly after 40 hours
Overtime Calculation Example:
Example: $25/hour, 50 hours worked in a week
- Regular Hours: 40 hours × $25 = $1,000
- Overtime Hours: 10 hours × ($25 × 1.5) = 10 × $37.50 = $375
- Total Gross Pay: $1,000 + $375 = $1,375
- Effective Hourly Rate: $1,375 ÷ 50 hours = $27.50/hour
Exempt vs Non-Exempt Employees:
| Category | Overtime Eligible | Salary Threshold (2024) |
|---|---|---|
| Non-Exempt Hourly | Yes | N/A |
| Non-Exempt Salary | Yes | Under $43,888/year |
| Exempt Salary | No | $43,888+/year + duties test |
Common Overtime Violations:
- Not paying for all hours worked (including prep time, cleanup)
- Misclassifying employees as exempt
- Averaging hours across pay periods
- Paying straight time instead of overtime rates
- Not including bonuses/commissions in overtime calculations
